At EvoLux LLC, we specialize in providing permanent LED installation services, combining aesthetics with functionality for a transformative lighting experience. This proposal outlines the payment terms and conditions for our engagement. By agreeing to these terms, both parties can expect transparency, reliability, and a seamless working relationship.
 
1. Initial Investment:For us to commence with the project, a down payment equivalent to 50% of the total project cost is mandated. This is not only a testament to the client’s commitment but also allows us to allocate resources and ensure timely project initiation.
 
2. Payment Options Post-Completion:After the successful conclusion of the installation, the remaining 50% can be settled in one of the following ways:
  • Lump Sum Payment:
    The total balance can be paid in a one-time payment, ensuring both parties are squared off immediately after the project’s completion.

  • Extended Financing Options:
    We understand the importance of flexible financial planning, we are offering extended financing options. Clients can choose to finance the outstanding balance over a 12-month or 24-month period. However, it’s imperative to note that our financing options are solely available via direct withdrawal from an ACH bank account.

  • evolux Lighting applies a simple interest rate to all financed installations, which corresponds to an additional 10% of the outstanding financed balance.

  • Please be advised that bank withdrawal fees may apply to transactions
    associated with the payment terms outlined in this proposal,
    specifically regarding the direct withdrawal from an ACH bank account
    under the extended financing options. It is advisable to consult with
    your bank to ascertain the applicable fees and charges that may be
    incurred. evolux LLC holds no liability for any bank fees or other
    financial charges that may be imposed on transactions as part of the
    payment process for our services.
 
3. Terms and Conditions:All payments are to be made in USD.
Late payments, if opting for the financing option, may be subject to interest and/or late fees as per Utah state laws.Failure to make scheduled payments could result in legal action or penalties.
All financial and personal information will be treated with utmost confidentiality and will not be disclosed to third parties without explicit consent, except where required by law.
Clients opting for financing will need to provide necessary documentation for ACH withdrawals.
 
4. Consultation and Further Information:Your trust and satisfaction are paramount to us. 5. Estimation and Measurement Process:Preliminary Estimation:
Our initial price estimate is derived from a generalized assessment method to provide clients with a ballpark figure. This is meant to give a rough idea and may not reflect the exact costs. It’s important to note that this estimation method may contain some measurement variances.
 
Confirmatory Measurement:
Upon a client’s agreement to proceed based on the preliminary estimate, a trained technician will be dispatched for a precise, on-site measurement of the installation lengths. This measurement will be used to finalize the project quote.
 
Price Adjustment and Threshold:
We understand the importance of trust and transparency in business dealings. Thus, if our exact measurement reveals an error margin within 15 feet of the initial estimate, Evolux commits to honoring the initially quoted price and will cover the cost for the additional product up to that threshold.If, however, the deviation exceeds this 15-foot margin, we will promptly notify the client before installation begins. In such cases, a revised quote reflecting the additional product requirement will be provided. This ensures that there are no unexpected costs or surprises post-installation.
 
6. Sales Tax Implications:Pre-sales Tax Estimations:
All prices presented within this proposal, or any associated documents are pre-sales tax estimates. These figures serve as a base cost and will not include the state and county-mandated sales tax, which will be calculated and applied separately.
 
Invoicing and Tax Application:
Sales tax will be applied to all equipment installed and will be clearly itemized in the final invoice. It is the client’s responsibility to settle this amount in addition to the quoted project costs.
 
Financing and Sales Tax:
Clients choosing our financing option should be aware that the applicable sales tax will form part of the initial down payment. This means that before financing terms commence, the sales tax is collected upfront, ensuring all statutory obligations are settled at the outset.
 
7. Severability Clause:
If any provision of this agreement is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be deemed severed from this agreement and shall not affect the validity or operation of the remainder of this agreement, and such remainder shall remain in full force and effect. The parties agree to replace any invalid provision with a valid provision that most closely approximates the intent and economic effect of the invalid provision.
